1. PERURAIL: Carrier.
2. CUSTOMER(S): Direct passenger(s) or Travel Agency(s).
3. TRAVEL TICKET: Proof of payment for the contracted transportation service.
4. DIRECT PASSENGER: Passenger whose travel ticket does not include the Taxpayer Identification Number (RUC) of a third party.
5. POINTS OF SALE: Locations where operations related to the sale of travel tickets are carried out in person.

1. In accordance with the provisions of Article 129 of the National Railway Regulations, approved by Supreme Decree No. 032-2005-MTC, the CUSTOMER, upon acquiring the TRAVEL TICKET, unconditionally and without reservation accepts all the terms and conditions established in this contract.
2. The TRAVEL TICKET is personal and nominative.
3. The change of ownership of the TRAVEL TICKET must be made at least twenty-four (24) hours before the train’s departure time, by presenting a copy of the identification document of the TRAVEL TICKET holder, a copy of the identification document of the new passenger, and the TRAVEL TICKET subject to modification.
4. Requests for change of ownership must be made by the purchase holder through the entity through which it was made. CUSTOMERS with direct purchases at PERURAIL can request a change of ownership by completing the corresponding form, or in person at the POINTS OF SALE. Partially used tickets cannot be changed in ownership.
5. Notwithstanding the provisions of numeral 3 above, PERURAIL will charge a ticket issuance fee equivalent to US$ 6.00 (Six and 00/100 United States Dollars) per travel segment (outbound or return) for the change of ownership of the TRAVEL TICKET.
6. A change of ownership of the TRAVEL TICKET will only proceed if the same fare conditions and passenger type (adult, child, etc.) as the original TRAVEL TICKET are met; if these requirements are not met, the CUSTOMER must make a new purchase. If the change of ownership corresponds to a higher cost passenger type or fare, the CUSTOMER must pay PERURAIL the fare difference. Refunds for changes to lower-cost fares or passenger types will not be processed.
7. If the CUSTOMER needs to update their identification details provided for the purchase of the TRAVEL TICKET, they may do so only once at least twenty-four (24) hours before the train’s departure time.
8. This transportation contract is subject to Peruvian legislation, particularly the regulations of the National Railway Regulations, its amendments, and related regulations. The CUSTOMER must pay special attention to the obligations established by the National Railway Regulations reproduced in Annex 4 of this document.
9. The purchase of TRAVEL TICKETS through the PERURAIL website is governed by the provisions of this contract where applicable and, additionally, by the terms and conditions established in Annex 3 thereof.
10. To exercise in person the rights and obligations related to the use of the transportation service referred to in these Terms and Conditions, it will be necessary to present the printed or virtual TRAVEL TICKET.

1. Every CUSTOMER boarding the train must have and is obliged to show their virtual and/or physical TRAVEL TICKET, valid identification document (National Identity Document, RENIEC Registration Certificate, passport, foreigner’s identity card, birth certificate, as applicable); additionally, this must match the information on the TRAVEL TICKET. Documents established in Ministerial Resolution 578-2020-MTC or those that modify it will also be required. In the case of minors traveling without their parents’ company, the permits required by applicable legislation must be presented. Additionally, the Infant and Child Policy described in Annex 2 will be observed. PERURAIL reserves the right to inspect the TRAVEL TICKET before and during the trip.
2. If the CUSTOMER does not present their identification document and, consequently, does not sufficiently prove ownership of the TRAVEL TICKET, their boarding may be restricted, and no type of refund will be processed under any circumstance or cause for such situation.
3. PERURAIL may refuse to provide transportation service, without any liability, to passengers whose TRAVEL TICKETS have incomplete or missing information, or who do not present their identification document, or the mentioned documents, before or during the trip.
4. In case of loss of the national identity document, the CUSTOMER may identify themselves with the copy of said document issued by RENIEC. In case of loss of the foreigner’s identity card or passport for foreign passengers, the CUSTOMER may identify themselves by showing a legible copy of said document and the copy of the corresponding police report.
5. The virtual presentation of identification documents is permitted to identify the CUSTOMER without having to handle their documents. However, in case of doubt or lack of clarity, PERURAIL may request that the original identification documents be shown.
6. Passengers must arrive for boarding 30 minutes prior to the time indicated on their TRAVEL TICKET. Capacity limitations have been established for stations, therefore, if not on time, access to them may also be limited.
7. PERURAIL reserves the right to restrict or deny the use of its services to individuals whose health condition is inadequate for travel and/or to women in advanced stages of pregnancy (seven months or more). If the customer wishes to use the services while in the aforementioned state, they must sign a Liability Waiver Form.
8. A passenger whose health condition may require them to be transferred by emergency or evacuation must contact a representative of the Ministry of Health, and travel with an escort and the pertinent documentation. The CLIENT exempts PERURAIL, its representatives, employees, and affiliates from any liability for any event that may affect their health, physical integrity, or life during the trip.
9. If a CLIENT exhibits symptoms or health problems during the trip, the train staff will inform the staff at the nearest station so that they can contact medical personnel for the passenger to disembark and receive care. The train will continue its journey. Medical, transportation, or other expenses generated by this situation will be borne by the CLIENT.

1. The TRAVEL TICKET only allows the transport of the CLIENT. Baggage transport conditions vary according to the train service and travel route.

   Luggage Dimensions:

   a) Carry-on baggage refers to bags or backpacks weighing 01 Backpack (max. 8kg) or 01 Carry-on bag (max. 12kg) and with a maximum dimension of 45 linear inches / 115 cm (height + length + width).

   b) Checked baggage refers to suitcases weighing no more than 23 kg with a maximum dimension of 158cm linear, calculated by adding height + length + depth.

2. Boarding with baggage exceeding the allowed limit will not be permitted. If the baggage exceeds the limit, it may be stored free of charge in the company’s deposit or a fee may be paid for the transport of additional pieces according to the current tariff.
3. BLOCKING OF EXITS WITH ANY TYPE OF BAGGAGE IS PROHIBITED BY LAW. PERURAIL reserves the right to remove any type of object and/or baggage that blocks any type of train exit.
4. The CLIENT may request the collection and transport of additional baggage by contacting equipaje@perurail.com, no less than 48 hours before the train’s departure. Such assistance is subject to space availability.
5. PERURAIL shall not be liable in any case for additional baggage or for baggage for which special attention was required but not requested by the CLIENT as established in this section.
6. Passengers are responsible for carrying their valuables and/or fragile items with them throughout the entire journey, and should not leave them in their baggage. PERURAIL will not be responsible for the loss or damage of any valuable item.
7. The CLIENT may carry a reasonable amount of medicines and personal items during the trip.
8. Before including any item in their baggage, the CLIENT must ensure that it does not contain prohibited, restricted, or dangerous items such as weapons, ammunition, explosives, flammable substances, or others that pose a danger.
9. Any claim regarding baggage must be made immediately after the train’s arrival at the station to the onboard supervisor or the car attendant.
10. The limit of liability for causes directly attributable to PERURAIL and duly proven, related to baggage that complies with the conditions established in this section, shall in no case exceed US $25.00.

1. Seats will be assigned in compliance with the provisions of the Ministry of Transport and Communications and Peruvian regulations. Passengers will not be allowed to change seats during the trip.
2. When for any reason, including operational, technical, fortuitous, or force majeure reasons, PERURAIL must relocate its CLIENTS to a different service or frequency, PERURAIL will make its best efforts to contact them and make the necessary arrangements. Relocations due to fortuitous events or force majeure will not be the responsibility of PERURAIL.
3. Relocation requests made by the CLIENT themselves will be attended to by PERURAIL according to the availability of its services and itineraries. PERURAIL will not assume any responsibility if the request cannot be fulfilled.
4. PERURAIL may change seats that have already been assigned, taking into account their availability.

1. In accordance with applicable legislation, smoking is strictly prohibited in any area of the train, including its public and private spaces and restrooms.

1. PERURAIL will make its best efforts to transport the CLIENT and their belongings safely, efficiently, promptly, punctually, and diligently, except for circumstances or factors beyond PERURAIL’s normal performance and/or that may affect scheduled itineraries.
2. In case of loss or theft of the physical TRAVEL TICKET, the passenger may download
   their ticket from the website, or go to a Point of Sale to request a resending of the ticket to their email, at least sixty (60) minutes before the train’s departure.
3. If the CLIENT misses the trip due to flight delays (weather conditions), strikes, or protests, PERURAIL will evaluate each case and offer, at its sole discretion and to the extent possible, the opportunity to change the travel date, depending on space availability. In these cases, no refund will be issued. If the missed trip is due to health reasons duly supported by a report, note, or medical certificate, a refund will be processed according to the percentages and conditions established in PERURAIL’s current Refund Policy.

Train departures and trip continuity are subject to change due to weather conditions, technical reasons, route conditions, fortuitous events, or force majeure.

1. PERURAIL assumes no obligation or liability for any change, delay, and/or stop, reasonably necessary or unavoidable, before or after the commencement of the contracted service, resulting from unexpected or unforeseeable action, omission, or any other event, act, or circumstance beyond PERURAIL’s control, including cases of fortuitous events or force majeure. Notwithstanding the foregoing, PERURAIL may, as a commercial policy and exceptionally, offer a partial or total refund in these cases, according to the criteria and official communications established in its current Refund Policy.
2. PERURAIL, if necessary, may modify the schedules, stops, or departure and arrival stations of the trip route, making every effort to notify the CUSTOMER in advance. If the CUSTOMER does not agree with such changes, they may cancel their trip and request a refund of the TRAVEL TICKET cost.
3. PERURAIL commits to making every possible effort to transport the CUSTOMER and their luggage with reasonable punctuality. The times indicated on the TRAVEL TICKET or in any other publication are not guaranteed as they may vary due to unforeseen force majeure, safety, or other extraordinary circumstances or events beyond the company’s control. PERURAIL will take all reasonable and possible measures to avoid delays in the transport of its passengers and luggage.
   a) If, for any duly verified cause directly attributable to PERURAIL, there is a delay in the start of the trip exceeding 2 hours, PERURAIL’s liability will be limited solely to the refund of an amount not exceeding the cost of the TRAVEL TICKET to CUSTOMERS who wish to cancel their trip.
   b) If such a delay occurs during the trip, depending on the segment in which it occurs, the liability will be limited to an amount according to the current percentage scale in PERURAIL’s Refund Policy, which varies according to the delay time, potentially reaching up to 100% of the cost of the TRAVEL TICKET for the affected segment.
4. Refunds will be issued to the same payment method/card used for the purchase.
5. PERURAIL is not liable for damages or losses that CUSTOMERS or their luggage may suffer, nor for delays in its delivery, or those produced in the issuance of TRAVEL TICKETS derived from situations beyond PERURAIL or any of its providers.
6. In cases of justified need or fortuitous events or force majeure, PERURAIL may, without prior notice, substitute the means of transport with an alternative or complementary one, modify or suppress intermediate stops, without assuming any liability.
7. If after the start of the transportation service, for any reason PERURAIL cannot complete it, PERURAIL will take all actions within its reach to provide the CUSTOMER with alternative means of transport to conclude the trip at no additional cost to them, all of this without any liability on PERURAIL’s part.
8. If after the start of the transportation service, the train must return to the point of origin, PERURAIL’s liability will be limited to refunding the passenger the cost of the TRAVEL TICKET via a credit note, which will be used for their new TICKET.
9. If the CUSTOMER, without a justified and proven cause, decides to disembark the means of transport before their final destination, they will do so at their own risk and responsibility, and must express this in writing to PERURAIL. If PERURAIL is required to provide another form of alternative transport and the CUSTOMER decides not to use said service, they will personally and exclusively assume all costs, risks, and responsibilities arising from such a decision.
10. In any of the situations established in items 1 through 9 of this section, PERURAIL will not assume any type of obligation or liability towards the CUSTOMER or third parties for delays or inability to make connections with other means of transport, or commitments made with hotels, restaurants, or other third parties.
11. All procedures to effectuate the refunds referred to in this section will be carried out according to section X of these Terms and Conditions.

1. Modifications of date and service are made only at least twenty-four (24) hours before the train’s departure time, subject to space availability. Modification requests for TRAVEL TICKETS purchased within a period equal to or less than 24 hours before the train’s departure time cannot be accepted.
2. CUSTOMERS can request date modifications by completing the corresponding modification form.
3. In case the modification is for the same service or a service with a lower fare, a 10% surcharge for administrative fees and 15% for Hiram Bingham, A Belmond Train, will be applied, with no refund for the fare difference.
4. In case the modification is for the same service or a service with a higher fare, a 10% surcharge for administrative fees and 15% for Hiram Bingham, A Belmond Train, plus the fare difference, will be applied.

1. The CUSTOMER may request a refund of the amount paid or a change in service only in case of breach by PERURAIL, lack of suitability, or exercise of the right of withdrawal, in accordance with Law No. 29571. Only the holder of the purchase will have the right to request a refund of the fare paid, and must prove their identity in accordance with the procedure established by PERURAIL for such a process.
2. Any passenger who does not appear at the origin station, or at stations prior to the destination, before the boarding cutoff for the service, and does not board the train upon its departure, WILL FORFEIT ALL RIGHTS TO THE TRAVEL TICKET, and no refund will be due from PERURAIL, except as provided for health-related cases duly supported according to PERURAIL’s current Refund Policy.
3. The CUSTOMER may request the cancellation of their trip only at least twenty-four (24) hours before the train’s departure. The cancellation refund process will have a cost of 10% of the TICKET value and 15% for Hiram Bingham, A Belmond Train. Refunds will be made to the same payment method/card used for the purchase.
4. Refund requests must be made by the purchaser through the entity through which the purchase was made. CUSTOMERS with direct purchases at PERURAIL may request a refund of the TICKET by completing the corresponding form. The cancellation request will only be accepted if the conditions established by PERURAIL are verified.

1. PERURAIL reserves the right, at its sole discretion, to refuse transport to any person who has acquired the TICKET illicitly, or whose TICKET is presented altered, damaged, or tampered with, or who violates applicable law, or who is under the influence of alcohol or drugs, or who represents a current or potential danger. PERURAIL also reserves the right to deny transport to any person who markets products or services without authorization.
2. PERURAIL reserves the right to physically inspect and search all luggage that may pose a danger to the safety of its passengers and workers.
3. Baggage will not be admitted, nor may persons under the influence of toxic substances; weapons, ammunition, explosives, or flammable substances; objects and/or animals that cause discomfort or block movement; protected species or archaeological items prohibited from transport, board.
4. In case the passenger forgets or loses an item during the trip, they may contact us to request information about it.
5. Lost items on board are kept by the staff of the respective station and taken to the security offices at Wanchaq Station (Cusco).
6. Lost items on board will be kept at the security office of Wanchaq Station (Cusco) for a maximum period of three (3) months, after which they will be disposed of through the Asset Protection office.
7. Passengers must follow all safety instructions in case of emergencies, whether due to internal, external, or natural causes.
8. In accordance with Article 135 of the National Railway Regulations, any person who endangers or causes harm to train occupants, rolling stock, and/or railway property will be handed over to the police authority.
9. Passengers must remain seated in their assigned seats and may only use the train’s services according to availability and authorization from PERURAIL.

1. No changes or returns are allowed. The consumer may request a refund of the amount paid or an exchange for the product only in case of non-compliance by PERURAIL, lack of suitability, or exercise of the right of withdrawal, in accordance with Law No. 29571. The deadline to request a refund is a maximum of seven (7) days from the purchase.
2. For a refund, an email must be sent to specialassistance@perurail.com attaching the proof of payment and identification document (and a copy of the voucher if it was with a credit card).
3. Once the request is accepted, the CUSTOMER must return the item to the PERURAIL office at San Pedro Station, Cusco, during the established hours. Items must be in the same condition as when purchased.

1. The CUSTOMER will provide PERURAIL with identifying data, considered personal data according to relevant legislation. The CUSTOMER may choose not to provide the requested information, except for that which is necessary for the execution of this contract.
2. The CUSTOMER authorizes PERURAIL to store, systematize, and use their personal data for the purposes of the contract, including sending commercial communications.
3. The CUSTOMER may exercise their legal rights (access, rectification, cancellation, and opposition) by writing to PERURAIL or datospersonales@perurail.com, and may revoke their consent at any time, except for legal exceptions.
4. The CUSTOMER acknowledges and accepts that PeruRail, associated with the Belmond Group, operates under the conditions of its Privacy Policy and may share personal data with third parties for data processing, reservations, marketing, and other purposes.

1. According to Peruvian legislation, the sale of alcoholic beverages to minors is prohibited.
2. During election periods, Peruvian regulations prohibit the dispensing and sale of alcoholic beverages from 08:00 hours on the Saturday preceding the elections until 08:00 hours on the Monday following election day.
3. In the cases mentioned above and in any case determined by Peruvian legislation, PERURAIL will replace alcoholic beverages with non-alcoholic beverages.

1. Infants and children must travel accompanied by a responsible adult (over 18 years of age).
2. Under no circumstances will PERURAIL assume responsibility for the care of infants and children; this is the exclusive responsibility of the accompanying responsible adult.
3. Infants

a) Infants are considered to be children between 0 and 2 years old.

b) They do not pay for a ticket if they occupy the same seat as the responsible adult.

c) If the infant occupies their own seat, the child fare (3-11 years old) is charged.

d) Each infant must travel with a responsible adult; an adult with two infants must pay for an additional seat at the child fare.

4. Children

a) Children are considered to be minors between 3 and 11 years old.

b) They must travel in their own seat, paying 75% of the adult fare.

c) They must travel with a responsible adult, who may travel with as many children as the reservation system allows.

The Bimodal Service combines bus and train, departing from and arriving at Cusco. The PeruRail service includes a private bus from Wanchaq Station to the train boarding station, with final destination Machu Picchu. The Belmond Hiram Bingham bimodal service includes a private bus from Wanchaq Station to the Rio Sagrado Hotel, with transfer to the train with final destination Machu Picchu; the return maintains the same bimodal service and includes transfer to hotels in Cusco.

1. If the CLIENT or any person on the Reservation is identified as a Sanctioned Person by a competent governmental authority, PERURAIL may cancel the Reservation without incurring liability, and will only be obligated to refund the amount if applicable legislation allows.
2. A “Sanctioned Person” is one included in sanctions lists or restrictive measures issued by the United Kingdom, USA, the EU, any EU Member State, the United Nations, and/or any other competent governmental authority.
